Conservation and Heritage

Scotland is justly proud of its natural environment and heritage. Landscape, buildings, history. These are areas where public meets private, where development and future needs can conflict with preservation and past achievement.
We have acted for The National Trust for Scotland since it was founded. Naturally this means we have great experience in dealing with all the issues that can arise from the care of a large property portfolio and associated conservation projects.
Issues can range from access rights to the impact of development. But conservation is just as much an issue for private owners.
We have the skills to help you, as an owner, in many ways, for example in negotiating with Scottish Natural Heritage and Historic Scotland over designations, proposals or reinforcement action.
Our team can also help you by:
- Providing guidance on land management where there may be conflict between conservation, access or use,
- Advising you on the sensitive development of heritage or conservation property,
- Providing you with strategies for succession and the preservation of heritage property within the family,
- Helping you establish maintenance funds for the financial support of heritage property,
- Advising you on conditional exemption from inheritance tax and capital gains tax for heritage land, buildings and historically associated contents and works of art, and
- Conducting negotiations with the Inland Revenue.
In these ways, and many more, we work to reconcile the competing interests of ownership, donation, conservation, protection, promotion, public access, tax and finance.
