Access

We have all been affected by the radical changes ushered in by right to roam. The Land Reform (Scotland) Act 2003, Part 1, gave everyone a right of access to Scotland’s lands and waters – with certain conditions and exceptions.
While this has brought relatively few problems, there are tensions. These can often be avoided, or at least brought to a satisfactory conclusion, with good legal advice.
We can offer you specialist expertise not just on the legislation, and supporting code of practice, but in the steadily growing body of case law on access. We have many landowners among our clients and so we appreciate people's concerns about privacy in their own homes.
We also understand the problems faced by anyone – from walkers to anglers or canoeists to horseriders – whose way has been unlawfully blocked.
A network of core paths is being created throughout Scotland. This is welcomed by many, but a proposed route can cause serious difficulties. Our access team can help you, whether it’s by raising an objection to a path or, if necessary, settling a dispute through the courts.
