OSCR has recently noted that some charities have not been complying with The Charities References in Documents (Scotland) Regulations 2007 which came into effect from 31 March 2008.  These Regulations set out the required information that charities must  include on an extensive list of documentation, including charities’ letter-headed stationery, emails and invoices.

OSCR is particularly concerned that some charities’ recruitment adverts are failing to include reference to the fact that these organisations are charities.  

We would suggest that all charities registered in Scotland check they are disclosing the required information on their recruitment advertisements which will include the following:-

  • The charity’s name as entered in the Scottish Charity Register;
  • Any other name by which the charity is commonly known; and
  • Its Scottish Charity number.
  • If your organisation makes no reference to its charitable status within its name, it must also refer to itself as a charity within the advert.

There is no specific area on the advert in which the required information must be displayed.  However, OSCR recommends that it should be placed in a prominent position. 

We are aware that many larger charities often use recruitment agencies to advertise for staff. Advertisements placed by such agencies must also comply with the Regulations.
